Dakota, a tree is a living organism. If you cut it, believe it or not,it bleeds. Personally, I am pleased that I have seen, in my lifetime,the rise of so many materials that take the place of wood.Unfortunately, timber is still used for buildings. There are still far too many trees being cut down.
Yes, I'n aware if that. I'm also aware if the spirits which reside within the trees. So long as you ask their permission and give back for what you take, cutting at an angle to support regrowth, I see no issue in taking a wand from a live tree, rich in sprowl and spirit, as opposed to a lifeless fallen branch. In my practice, taking something dead will not result in a powerful tool. Any wood used must be taken with permission and offering.

Sorry, but you are not "aware of the spirit that resides in a tree"; you "believe" that a spirit is there! And do you really think that there is no energy in anything that is no longer "living"? A fallen branch has a great deal of energy. It releases carbon into the atmosphere; nutrients into the soil.It is not really "dead" until it completely rots away.
Although I like your idea of the "tree spirit", it is your belief! It may, or may not, be true!
Well, you see, that's the great thing about this forum, someone asked for our advice. Someone else told them they must take only fallen wood. My advice differs from that, per my experience. And no, I am AWARE of the spirit. You may call it what you want, but I personally am aware. You may choose to believe as you wish. You may not, however, attempt to discredit my belief by saying it may or may not be there, much the same way I may not discredit your belief. if fallen wood works for you, then keep using it, and do so proudly! Everyone has their own way, and I have chosen to provide the questioner here with my way. I did not state it MUST be done this way, I simply provided a method. I also shared a method commonly used. To answer your question, fallen wood is useless wood to me. There is no more spirit force left, no more life. Unless the fallen wood is still green, no. If you choose to use a fallen branch, taking the time to craft into it your personal power, that is different. That fills it with your power, but the spirit force of the tree is gone.. Again though, that does not change the fact that in my belief system, I work things the way I choose to work them because I have found it to work for me, not dies it change the fact that you believe the way you do.
Back to the question at hand, you may also find carving certain figures, runes, shapes, etc. into the wand to add more of your own spirit force/power/energy to it. The more time and dedication you put into something, the more connected you will become.
